October 18, 2014
I am pleased to be a guest speaker at the Canadian Society of Association Executives’ (CSAE) National Conference 2014 in Niagara Falls this fall (October 29-31). I will be co-presenting with Mark Katz of Davies Ward Phillips & Vineberg, the co-author of our competition law and associations book. Below is an overview of our seminar.
Competition Law: Codes of Ethics, Surveys and Recent Developments for Associations
Part 1 – Are “Codes of Ethics” Ethical?
Part 2 – A Survey of the Law on Member Surveys
Competition law compliance is important for all voluntary trade and professional associations in Canada. Violation of Canadian competition laws can lead to significant liability for associations, their members and leadership. As such, relevant and practical competition law knowledge is a benefit to association directors, officers and other personnel. Codes of ethics and surveys are two particularly important areas for associations from a member value perspective. They can, however, also raise competition law concerns if not approached with an eye to potential competition issues. The goal of this session will be to discuss how codes of ethics and surveys can go astray and set out practical ways to avoid issues.
CSAE Learning Outcomes: (1) assist association leadership become more fluent with key competition law concepts that apply to associations; (2) illustrate some pitfalls and potential risks of association codes of ethics and surveys; (3) provide understanding where “the line” is between acceptable codes and surveys and those that may raise competition risk; and (4) update attendees on recent competition law developments relevant to associations.
