Industry Canada has announced that the monetary threshold for review for WTO investors or vendors, other than Canadians, is expected to be $312 million for 2011 and that the official threshold would be published in the Canada Gazette in early 2011.

On October 22, 2010, the Competition Bureau issued two updated merger control guidance documents: an updated Fees and Service Standards Policy for Mergers and Merger-Related Matters (“Merger Policy”) and Fees and Service Standards Handbook for Mergers and Merger-Related Matters (“Merger Handbook”) (which had been issued for public comments – see: Competition Bureau Issues New Draft Fee and Service Standards Handbook for Mergers for Comment). Both of the Bureau’s new merger guidance documents come into effect on November 2, 2010.

The Competition Bureau announced today that it had reached an agreement with The Coca-Cola Company to address its competition concerns in relation to Coca-Cola’s proposed acquisition of the North American business of its primary bottler (Coca-Cola Enterprises Inc.). Before the proposed acquisition, Coca-Cola Enterprises produced, marketed and distributed not only Coca-Cola products but also products for Dr. Pepper Snapple Group, Inc.

Somewhat in contrast to recent developments in the BHP/Potash transaction, BHP received some good news today. Reuters and others are reporting that the BHP has received U.S. antitrust clearance (Hart-Scott clearance) for its bid for Potash Corp.
