November 18, 2022

On November 17, 2022, Canada’s federal government announced a sweeping stage II review of Canada’s competition laws (see: Consultation on the future of competition policy in Canada).

In announcing the consultation, the government said:

“The Government of Canada welcomes your perspective and comments on a wide range of issues, including how to ensure the law and its provisions remain effective in serving our national interest, and how to improve or protect competition in emerging data and digital markets.”

On June 23, 2022, Bill C-19 (the Budget Implementation Act, 2022, No.1) received royal assent, introducing sweeping amendments to Canada’s federal Competition Act. These amendments include significant increases to the civil and criminal penalties under the Competition Act, new wage fixing and no poach offences and new criminal and civil prohibitions on drip pricing.

On February 8, 2022, Canada’s Competition Bureau released a submission entitled Examining the Canadian Competition Act in the Digital Era in response to Senator Howard Wetston’s invitation to comment on Canada’s competition policy framework.

The Bureau’s submission includes sweeping recommendations to amend many of the core provisions of the Competition Act, including its purpose (section 1.1) and its abuse of dominance (sections 78 and 79), civil agreements (section 90.1), conspiracy (cartels) (section 45), bid-rigging (section 47) and criminal and civil deceptive marketing (section 52 and 74.01) provisions. The last major legislative overhaul of Canada’s Competition Act was in 2009 (see: Amendments).

The term of Canada’s current Commissioner of Competition, John Pecman, ends soon. In this respect, the CD Howe Institute’s Competition Policy Council is making two general recommendations for the mandate of the next Commissioner in its new Communiqué entitled Help Wanted: Priorities for a New Competition Commissioner: first, improve the timeliness and efficiency of the Bureau’s operations; and second, ensure that the new Commissioner vigorously pursues his or her mandate to act as an independent, strong and relevant public advocate for competition.
