I am quoted in this month’s Canadian Lawyer Magazine on the Competition Bureau’s enforcement and compliance efforts in relation to trade associations. This article is a very good roundup of current Bureau enforcement and compliance focuses with practitioner and enforcer perspectives.
Associations are a current Bureau priority and are now commonly included in its investigations, litigation and negotiated settlements. The Bureau has also issued detailed association-specific compliance guidance over the past several years. Its updated Corporate Compliance Programs Bulletin includes specific compliance recommendations for trade and professional associations, which is essential reading for association leadership.
Association executives should review their current compliance programs and, if necessary, update and amend them to reflect the Bureau’s current compliance approach for associations. It is also incumbent on association executives to obtain advice in relation to specific projects or initiatives that may raise criminal or civil competition law risk.
