On December 15, 2023, Bill C-56, An Act to amend the Excise Tax Act and the Competition Act, S.C. 2023, c. 31 (Bill C-56), which introduced the first of two new sweeping rounds of amendments to the federal Competition Act, R.S.C., 1985, c. C-34, received Royal Assent and important amendments to the Competition Act came into force on that day. For more information, see Competition Bureau, Guide to the December 2023 amendments to the Competition Act (December 18, 2023).
This first new round of amendments, which is expected to be followed in early 2024 by Bill C-59, An Act to implement certain provisions of the fall economic statement tabled in Parliament on November 21, 2023 and certain provisions of the budget tabled in Parliament on March 28, 2023 (Bill C-59), is intended, among other things, to strengthen the ability of the Competition Bureau (Bureau) and private parties to enforce key provisions of the Competition Act and to strengthen overall competition in Canada. Together, these two rounds of amendments, assuming Bill C-59 will also be enacted in 2024, represent in many respects the most significant changes to Canada’s competition laws since the Competition Act replaced the former Combines Investigation Act in 1986.
