The federal Competition Act (the “Act”) contains both civil and criminal provisions dealing with false or misleading representations (commonly referred to generally as “misleading advertising”). In addition, the Act also governs a number of specific forms of marketing conduct including “ordinary selling price” claims (claims made in relation to sales), performance claims, selling above an advertised price, deceptive telemarketing and promotional contests.

In R. v. Nova Scotia Pharmaceutical Society, the two defendant Nova Scotia pharmacy associations attempted to negotiate a maximum fee tariff on behalf of their member pharmacists and pharmacy operators with third party insurers, which included powers of attorney giving the associations the power to act on behalf of their members.

Canada’s national broadcaster, CBC has reported that Bell Canada’s Solo wireless brand is planning to introduce unlimited calling and texting plans later in August. CBC states that, according to Bell Canada’s chief executive George Cope, the new plans are part of repositioning to compete with Rogers’ recently launched Chatr brand (and to compete with new mobile carriers Wind Mobile, Mobilicity and Public Mobile, which already offer plans with unlimited texting and voice calls).

In R. v. Independent Order of Foresters, a fraternal benefit society engaged in the sale of life insurance was charged with misleading advertising under section 52 of the former Combines Investigation Act in relation earnings claims made for the recruitment of salespersons.

Legislation
Competition law in Canada is governed by the federal Competition Act (the “Act”). The Act is federal law of general application that contains criminal and civil sections and applies to most business activities in Canada, with few exceptions. The Act is administered and enforced by the federal Competition Bureau (the “Bureau”), which is a federal enforcement agency headed by the Commissioner of Competition (the “Commissioner”). While competition law was introduced in Canada in 1889 (one year before the introduction of the Sherman Act in the United States), Canadian competition law has for the most part only been actively enforced in Canada since 1986 when Canada’s new Act was introduced and when a number of changes were made to Canadian competition law to mark Canada’s modern era of competition law.
