On July 30, 2010, the Competition Bureau issued its July issue of CB in Brief. The Bureau’s CB in Briefs is a relatively new publication for the Bureau, which contain summaries of the previous month’s Competition Bureau News.
July’s edition of CB in Brief announces that an Alberta man has been convicted of GST fraud under the Competition Act (who has been convicted of one count of misleading representations under the criminal misleading advertising provisions) and the Bureau’s recent role in the U.S. Federal Trade Commission’s settlement against Mutual Consolidated Services, a company that allegedly made false claims to consumers to reduce credit card interest rates. The FTC settlement order requires MCS to pay about USD $1.5 million, to be distributed to both Canadian and American consumers.
These two recent misleading advertising cases show that misleading advertising and other forms of deceptive marketing, particularly intentional and fraudulent deceptive marketing, continue to be top enforcement priorities for the Bureau.
