On September 9, 2021, the C.D. Howe Institute’s Competition Policy Council (Competition Council) issued a new Communiqué with recommendations for the next Canadian federal government to amend the Competition Act and other Canadian competition policy recommendations.

Canada’s federal anti-spam legislation (CASL), which is one of the strictest anti-spam law regimes in the world, applies to commercial electronic messages (CEMs) that encourage participation in a commercial activity. While CASL was passed more than seven years ago, there remain a number of common misperceptions relating to consent under CASL, including the distinction between express consent, implied consent and what kind of consent is needed to share electronic addresses with third parties.

The Competition Bureau (Bureau) recently began posting new Compliance Bootcamp compliance videos. In this regard, on August 19, 2021 the Bureau posted its Avoiding Business Collusion and Bid-rigging Compliance Bootcamp videos. These compliance videos set out guidance to avoid engaging in bid-rigging under section 47 of the Competition Act and conspiracy, and in particular price-fixing, under section 45 of the Act.
